1. Purpose
These General Terms and Conditions of Sale (GTC) govern the sale of products and services offered on the website www.univers-aquaponie.com by the company Aquaponeasy, a simplified joint-stock company, registered with the RCS of Sarreguemines under number 98159999600015, with its head office at 14 rue du Hommel 57600 Forbach.
They define the rights and obligations of the parties in the context of online sales of aquaponics-related products (kits, equipment, accessories, etc.) to consumers.
2. Acceptance of the GTC
Any order placed on the site implies full and unconditional acceptance of these GTC by the buyer. They prevail over any other document.
3. Products
The products offered are those described on the site. Univers Aquaponie makes every effort to describe them accurately, but slight variations (photos, color, dimensions) may occur.
Some products require assembly or use in accordance with the provided instructions.
4. Prices
Prices are indicated in euros, including all taxes (VAT included). Univers Aquaponie reserves the right to modify its prices at any time, but the price charged is the one displayed at the time of the order.
Shipping costs are specified before order confirmation.
5. Order
The customer places an order via the website. Order validation implies acceptance of the GTC. A confirmation email is sent to the customer.
Univers Aquaponie reserves the right to refuse or cancel an order in case of a dispute with the customer or product unavailability.
6. Payment
Payment is due at the time of ordering. It can be made by credit card, PayPal, or any other method offered on the website.
Payments are secured via solutions that comply with current standards.
7. Delivery
Products are mainly delivered within mainland France (and in the areas specified on the site). Delivery times are estimated and not guaranteed.
In the event of a significant delay or parcel loss, the customer may contact customer service at contact@univers-aquaponie.com.
8. Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, the customer has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without having to justify reasons or pay penalties.
To do so, the customer simply needs to notify their decision in writing to "contact@univers-aquaponie.com" or via our contact form available on the site. Products must then be returned in their original condition, complete, unused, and in their original packaging.
Return costs are borne by the customer, except in cases of our error (defective or non-compliant product). Any incomplete, damaged, or soiled item returned cannot be accepted or refunded.
Refunds will be issued within a maximum of 14 days following actual receipt of the products or upon presentation of proof of shipment by the customer, whichever comes first, using the same payment method used at the time of ordering. The right of withdrawal does not apply to personalized or made-to-order products, those likely to deteriorate quickly such as certain plants or living organisms, or opened products that cannot be returned for hygiene or safety reasons.
9. Warranty and After-Sales Service
Products are covered by the legal warranty of conformity (Articles L217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code).
In case of defect, the customer must contact customer service with photos and a description.
Some products benefit from a specific manufacturer's warranty (mentioned on the product sheet).
10. Liability
Univers Aquaponie cannot be held liable for indirect damage related to the use of the products, particularly in the event of improper installation, failure to follow instructions, or inadequate maintenance.
11. Intellectual Property
All elements of the website (texts, images, videos, logos, trademarks) are protected by intellectual property rights. Any reproduction is prohibited without written authorization.
12. Personal Data
Univers Aquaponie collects personal data to process orders. This data is stored in compliance with current legislation. The customer has the right to access, rectify, and delete their data via contact@univers-aquaponie.com.
13. Dispute Resolution
In case of dispute, the customer may contact customer service for an amicable resolution. Failing that, the dispute shall be submitted to the competent French courts.
In accordance with Article L612-1 of the French Consumer Code, the customer may seek free recourse to a consumer mediator.
14. Applicable Law
These GTC are governed by French law.
